For nearly half of Britney Spears’s decades-long career as a world-renowned pop star, the “Womanizer” singer hasn’t held full control of her life. Britney has been under a conservatorship helmed by her father, Jamie Spears, since the singer’s infamous breakdown 12 years ago, which resulted in hospitalization and rehab. Though the stigma surrounding Spears’s mental health battles has followed the singer since 2007, her career never faltered. Marking an official comeback with her 2008 album, Circus, Britney continued to release albums, tour, star in a years-long Las Vegas residency, and launch business ventures including her lucrative perfume and namesake lingerie lines.
Despite multiple comebacks, however, Britney’s longtime fans have vocalized their dissatisfaction in seeing the pop star continue to be under a conservatorship at 38 years old. Wholeheartedly convinced that the singer herself also wants to be free from the legal binding, fans launched the #FreeBritney movement, utilizing social media to bring awareness to the discrepancies surrounding the conservatorship.

A Call for Executive Oversight of Guardians

 With increasing numbers of Americans living longer, many are finding themselves under guardianship. The guardian appointed may be a family member or friend, or a “professional” guardian or guardianship company.

In many cases, the guardian is honest and hardworking. Unfortunately, in some cases, however, the guardian abuses or exploits the ward. The exact magnitude of this problem is not known, but the names of articles in the popular press tell the story.1

The Courts Respond
The issue of guardianship abuse also has caught the attention of the courts. The Supreme Court now oversees the “Certified Professional Guardian Program.”2 With this program, there are two entities that supervise professional guardians: the Certified Professional Guardian Board and the Superior Court in each county.3 The Board reports to the Supreme Court.

The premise of this article is that this well-meaning effort to increase guardianship accountability is misplaced. Although courts traditionally have been responsible for guardianship oversight, they are ill suited for this function. Guardians should be licensed and regulated under the executive branch, not supervised by the courts.

The Media Wakes up to the Abuse!

I was excited when “Edith and Eddy” came out and was nominated for an Academy Award. I was thrilled to witness the success of Billy Mintz’s “The Guardians” movie. I was shocked by Netflix Episode 5 in 2020 on “Dirty Money” about guardianship abuse. I was amazed at the in depth expose by Gretchen Rachel Hammond of the racket in Michigan. I have been delighted to see article after article in the press from local papers in States like New Mexico, Florida, California, Colorado, Texas, Michigan and so many others to the Wall Street Journal and New York Times to the New Yorker magazine and so many other, publish revealing stories about the epidemic of guardianship abuse in America.

But February 19, 2021 was a special day. The blockbuster movie “I Care a Lot” was released on Netflix.

This film is a tour de force! It perfectly depicts precisely what every guardianship victim has experienced. The lies in the courtroom, the compliant Judge, the lockdowns, the greed driven doctors and facility owners, the starvation, the drugging, the theft of property, the sale of homes, how the “cherries” are picked, the sleazy lawyers, the massive money and lucre involved, the fury of the victims and their desperate but always failed attempts to free their loved ones, the arrogance of the predator class–all of it in agonizing detail! Rosamund Pike’s portrayal of the guardian Marla Grayson is more than spot on–her performance is mesmerizing! This is the most accurate and precise depiction of the racket ever. Admittedly the sub plots including Marla’s love life, the “victimized” Russian mobster and his story are fictional

In fact, yesterday the Florida State Guardianship Association publish a polished but panicked opinion piece in all the major state media including the South Florida Sun-Sentinel warning people not to believe what the movie so accurately portrays!

Aunt

My nephew has lost a substantial amount of weight after being placed under a public guardian’s care by court order.  He lives in Reno, NV.  His warm coat was taken from him.  He shows up in below-freezing weather with just a T-shirt on.  He was so cold one day he took his mother’s coat after one of her extremely-limited visitations.  His mother has evidence of rotten food the home is trying to make him eat.  Law enforcement has been called for welfare checks and they do nothing.  Reports are made to the commision put in place in Nevada to investigate and they do nothing.  The judge that revoked my sister’s guardianship IS A MEMBER OF THE SAME COMMISSION.

His mother’s guardianship was revoked after she tried to move him out of the home he is now a prisoner in.  Strike that – PRISONERS ARE TREATED BETTER THAN HE IS!!!  She went to the court to petiition moving her son out of the home.  The home, at the same hearing, petitioned to have my sister’s guardianship revoked.  The judge, at this hearing, revoked my sister’s guardianship and he awarded guardianship to a public guardian.  My sister’s due process was violated.  The hearing lasted 5 minutes, if that.

When his mother appealed the initial order to try to get guardianship back, (filed for reconsideration), it was denied.  A subsequent hearing was ordered on January 24, 2020.   At this hearing, an investigation report was presented as evidence by the Guardianship Compliance Office, and it was full of lies and highly subjective to the home.  I know this, as facts in the report about myself were incorrect.  I was never even contacted when this alledged investigation was happening and was shocked when my name showed up in it!  MY SISTER NEVER EVEN MENTIONED ME AT ALL DURING THIS ENTIRE NIGHTMARE!!! Evidence provided by my sister to repute the ‘investigation’ WAS NOT PRESENTED AT THE HEARING BY HER LAWYER, ELIZABETH BITTNER.  Her lawyer showed up late and did nothing after charging a retainer of 5000.00.  My sister kept asking the lawyer, even after this fiasco, about filing an appeal, and her lawyer, after telling my sister that even if an appeal was filed, no new evidence can be presented, and quit.

My nephew, thin when, in good faith his mother placed him in this home, is now LITERALLY skin and bones.  He is not in good health and has a speech impediment.

My sister’s evidence is mounting.  She tirelessly scans the internet for someone to help. I pray every day she finds someone to help IN TIME.

The judge is Egan Walker.

While people, like my sister, consider placing a loved one in a home in an effort to get them more help to care for their loved one, I hope they read this post and find another way.  Money is driving up the availability of such homes, nothing else.
